1. Scope

These Terms of Service (“ToS”) apply to all services provided by ARTmeetAI via ARTmeetAI.com.

2. Services

• ARTmeetAI operates a platform where users submit AI-generated images and commission human artists to enhance or alter them.
• We provide only the editing and hosting service; all submitted content originates from the user.

3. Payment & Pricing

• Fees range from €10 to €100 depending on the scope of work and complexity of alterations.
• Payment is due upon order confirmation.
• No refunds are possible. Withdrawal is only permitted if both parties agree and within a 7-day reflection period.

4. User Rights & Licenses

• Users retain all rights to their original images.
• By submitting an image, the user grants ARTmeetAI a non-exclusive license to edit, display, and host the image.
• Enhanced images are provided as a service; ARTmeetAI does not sell the underlying artwork.

5. Liability & Warranty Disclaimer

ARTmeetAI offers artistic services without any guarantee of specific results or satisfaction of individual taste. All works reflect our creative style; if you disagree, please do not place an order.

Maximum liability is limited to the value of the respective order. We assume no liability for third-party rights (e.g., licensed images) and cannot verify copyrights of submitted content.

6. Governing Law & Jurisdiction

These ToS are governed by Austrian law. Exclusive place of jurisdiction is Bregenz, Vorarlberg, Austria.

7. Online Dispute Resolution

The EU Commission provides an Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr

8. 18 U.S.C. §2257 Compliance

ARTmeetAI is not the primary or secondary producer under 18 U.S.C. §2257. All content is user-submitted. Requests regarding §2257 records should be directed to the uploader or to legal@artmeetai.com.

9. Data Protection & Tracking

• We collect only minimal contact data (email, username) to process orders.
• No cookies are used. We track mouse movement and section loads solely to gauge user interest; no other personal data is collected.
• Usernames are published when donations are made; donors may choose a pseudonym or receive an automatically generated username.
• Payment data (PayPal, Patreon) is processed exclusively by the payment provider.

10. Indemnification

Users agree to indemnify and hold harmless ARTmeetAI and its affiliates against any claims, damages, or expenses arising from user-submitted content that infringes third-party rights or violates laws.

11. Amendment of Terms

These ToS are effective as of August 1, 2025. ARTmeetAI reserves the right to amend these terms. Updated ToS will be posted at ARTmeetAI.com and apply from their publication date.
